charges of official misconduct. and that means the mayor did not have enough votes to remove the sheriff from office, and he can now be reinstated. board members started deliberating at 9:30, many made emotional statements about family members being victims of domestic violence. but supervisors christina olagi, john avalos and jane kim said while what murkarimi did was wrong, the charter is too narrow to support removing him from office. >> while the emotion satisfaction and political expedience of removing an official for a crime that most of us find unacceptable is very tempting to me, that is precisely the danger of removing an elected official for official misconduct for actions before that person are officially in office. it is a dangerous precedent to set. >> reporter: ross murkarimi supporters turned out by the hundreds for this hearing. the suspended sheriff and his wife sat attentively for hours tonight. murkarimi's wife eliana lopez

cried as she listened to members of the board announce that they would vote no when she realized murkarimi can keep his job. mayor ed lee needed nine votes to remove the sheriff from office, and tonight it became clear before a final vote count even took place he did not visit. by a vote of 7-4, the board of supervisors does not sustain official misconduct charges, and sheriff ross murkarimi can be reinstated. reporting live in san francisco, jean elle, nbc bay area news. i can't talk. i'm going to start crying. it's unbelievable. >> the other big story tonight, the giants and a's are both still alive. the teams came up with big wins with their backs against the wall. for both of them, it was a do or die situation, and they did it. >> boy did they do it. hen they did, the giants in dramatic fashion. the a's won in front of a packed and vocal house. >> we have leave coverage.

cheryl hurd is live outside coliseum. but first kate longworth has highlights from tonight's game. hi, kate. >> reporter: hey, ladies. well, it was win the baseball game tonight or book your golf tee times tomorrow. both the a's and giants proved that they did not want their magical seasons to come to an end. the a's were down two games in this best of five series to detroit. and they sent brett anderson to the mound in front of a sold-out crowd tonight at the coliseum. anderson showed no sign of his previous oblique injury while seth smith led the offense for a 2-0 a's vic troy keep their season and postseason alive. >> especially at home in front of these fans is unbelievable, you know. they came out and they were supporting us from the get-go. i feel like i was pitching the game and warming up in the bull pen. you can't give these fans enough credit and the guys behind me. it was fun. i can't describe it any other way.

down below that told you which game number three was. and that was the first home game. >> reporter: and there lies the confusion. some a's fans purchased game three tickets thinking they were good because this is the third time the a's face off against the tigers in this play-off series. but a's officials say the tickets for tonight's game should not say three, but one. and number one means that the tickets are for the first home game in the series. >> it's obviously the way baseball sets it up. it's the same thing in the world series. they've been doing this for years that way. and it's unfortunate that there is a misunderstanding. >> reporter: this ticket mix-up was not a way to keep fans happy. but the game didn't disappoint fans inside the stadium. the sold-out crowd hung on every pitch, strikeout, and swing. and in the end -- >> we won! and slick spots on the roadways. here is a look at that satellite radar picture over the past hour. it really swept across quickly from south san jose through campbell. continuing to hold up across the san francisco peninsula. we did note some areas of lightning and also thunder with this thunderstorm cell. but at the current moment, we're not detecting any lightning right now south of san francisco. here is the thing. as we put a storm track on this, it looks like it will hold up over the next hour. right across the san francisco airport, likely producing delays, and even into downtown san francisco. so this first fall rain is finally ah living here across the bay area. but again, we'll continue to create some slick roads, even as we head into our wednesday commute. as this system drops to the south, we're going to find widespread problems. not only isolated showers, but more potential thunderstorms and even snow across the sierra. we're going to detail all of this in the timeline in what you can expect for tomorrow morning coming up in a few minutes. >> we'll see you then.

in the clear, the oakland police officer who shot and killed an 18-year-old high school student during a foot chase will not face criminal charges. the alameda district attorney's office ruled today that the shooting back in may was justified. prosecutors say officer miguel masso shot allen blueford three times after he ran from officers and he pointed a gun at the officer. the controversial shooting as you may remember sparked protests in oakland. a chaotic scene. that's how investigators are now describing the moments before a man was hit and killed by an suv on highway 87 in san jose. "the mercury news" says that man has been identified as 22-year-old alejandro sandoval. the chp says he ran on to the highway after a fight at a nearby home. relatives tried to stop him but couldn't. the driver who hit him did not stay at the scene. investigators did catch up with the driver, but so far no arrests have been made. tonight police are still looking for a suspect in a hit-and-run crash that injured a

student, a school crossing guard, and parent. police say the driver plowed through the intersection at delta fair boulevard near turner elementary school this morning. the three victims were standing on the corner. the adults were severely hurt. the child, though, is expected to recover. antioch police arrested the man who identified himself as a driver. but they are still looking for the passenger who ran from the scene and has an outstanding warrant. coming up, it's happened again. another family pet stolen during a home break-in. this time in pleasanton. we'll hear from one of the victims. plus, it's not your typical rental property in san francisco. see inside this multimillion-dollar home where dreams are being made. and more on our breaking news. sheriff sheriff ross murkarimi just walked out of city's hall, and he got his job back. we spoke to him moments ago. a live report with his reaction when we come back.

back to our breaking news. he is getting his job back. after ten harrowing months san francisco sheriff ross murkarimi just walked out of city hall and says he has got his job back. we just spoke to him. jean elle is live on the scene right now after talking to him. >> reporter: jessica, ross murkarimi says he is ready to move forward. he says after ten months of fighting to keep his job, he is ready to prove he will be a good sheriff. >> but now it's about moving forward. we want to mend fences with all parties. i look forward to demonstrating why the people elected me as

sheriff and look forward for me and my family to now move in a place where we hopefully will see some normalcy again. >> reporter: now you can see in that video his wife, eliana lopez is all smiles. by a vote of 7-4, the board of supervisors does not deliver enough votes to have the sheriff removed. so he can keep his job. now the vote is a defeat for san francisco mayor ed lee who wanted murkarimi removed. the mayor did just issue a statement. it says he is disappointed by the board's vote. it guess on to say the board's decision returns a convicted domestic batterer to lead the sheriff's office, and i am concerned about our city's nationally recognized domestic violence programs. you may be able to see behind me that sheriff murkarimi has just come out of city hall to applause. lots of supporters were here on his side tonight, testifying before the board. and the board, again, voted not to remove him from office. we're live in san francisco tonight, jean elle, nbc bay area news. >> and i'm sure we're going to be hearing more from mr.

murkarimi and his wife eliana lopez in the coming days as we continue to cover this story for you. another home break-in. another dog stolen. but this time it happened in pleasanton. burglars broke into a family's home monday morning, taking some of their electronics jewelry, and then they also took the family dog, a pug named holly. the family discovered their living room glass door had been shattered and their home ransacked. neighbors told the family they didn't see or hear anything. cynthia found out her dog had been stolen when she came home from school. >> that even though what happened was so cruel and you know, it's really unforgivable. but i just hope they have some conscience to see that i just want my dog back. >> police say another home a few blocks away was also burglarized the same day. this is unusual for pleasanton. last week a san jose family you may remember had their home broken into and their dog miko stolen. now miko was found and returned to the family a few days later.

hopefully the same will happen in the pleasanton case. big bird's feathers are a little ruffled tonight over a new obama campaign ad targeting mitt romney. >> big bird, big bird. >> it's me, big bird. >> big, yellow, a menace to our economy. mitt romney knows it's not wall street you have to worry about, it's "sesame street." >> i'm going to stop the subsidy to pbs. >> mitt romney taking on our enemies no matter where they nest. >> the obama campaign launched the new ad following last week's presidential debate where romney talked about cutting public funding to pbs, even though he likes big bird. but "sesame street" workshop, a nonpartisan not for profit group behind "sesame street" says it did not approve this ad and wants it pulled from the airwaves. it is a first for san francisco, a target store, not just ordinary target, though. it's a city target. or as we like to call it, tar-jay. that meant a long, long line to get into the official opening

tonight at san francisco's metreon. it is one of eight smaller stores opening all across the country to serve busy urbanites they call it. it opens an hour earlier at 7:00 a.m. it features a separate active apparel store, and it has an outdoor seating and eating area. silicon valley's startup spirit is moving north. fremont is now ranked the top city in the nation for tech startups. sizeup.com, a san francisco-based website found fremont has the most tech startups before capita. the rate of startups is twice as high as san jose which placed second. city officials of fremont say they've made it a priority to lure entrepreneurs to the city. a group of young techies have figured out a way to live the high life in one of san francisco's toniest hoods without breaking the bank. stephanie trong joins us with more on this mojo mansion

entrepreneurially-minded really is a huge benefit to trying to start a business. >> reporter: buckley started his ipad cover business just five months after moving here in 2010. >> the case is born in this very room. i was assembling and boxing our first products. >> reporter: the business has grown exponentially since the early days, and now he's got a huge warehouse churning out up to a thousand cases a day. buckley's success is inspiring to turee who posed his career in finance to start an all-natural grass-fed beef jerky business, even though he calls himself mostly vegan. >> it is quite a shift. it's nothing that i really had planned. but i was just frustrated with the lifestyle of finance. seeing some of my housemates succeed, seeing them take risks is really helpful. >> reporter: and no, they're not

hobnobbing with their billionaire neighbors. >> i wouldn't say we're that tight. >> reporter: and there have not been billionaire investments. but they do set their sights on achieving the billionaire dream. >> like wow, you know, if we work really hard, maybe one day we won't be renters here. >> reporter: and among the housemates is patrick buckley's wife. buckley says they have no plans to november move any time soon. at least living with a bunch of dudes, but in a mansion. >> a very nice mansion. >> i guess you could do worse, which a great view. and if you look outside right now, a bit of rain possibly where you are. let's check with chief meteorologist jeff ranieri. >> that's right. we are tracking our first fall rain moving across the south bay. a few areas of isolated showers and thunderstorms moving across the peninsula, even the north peninsula. what i want to turn your attention to right now is the fact that it is 11:19, and we are still finding plenty of instability up in the atmosphere just to the south of santa cruz that is a great indication that for tomorrow we are definitely going to find the chance here of

isolated showers and thunderstorms continuing in that forecast. but it's going to be that nature a very hit and miss. not everybody is going to see something here as we head throughout the next 24 hours, just like for tonight. across the peninsula it was pretty wild over the past 35 to 40 minutes. it started to calm down. we had a few lightning strikes. no damage or anything like that reported. up here into san francisco, you may actually have some flight delays tonight as we are looking at heavier rainfall right near the airport on 101. this is pushing to the north in kind of an odd fashion across san francisco. you can see we'll be looking at some showers also moving into downtown as we head throughout the next 30 to 40 minutes. rite now plenty of numbers in the 50s and 60s. let's take you outside of the live hd sky network. something we haven't seen this widespread in our four to five months. we have the wet roads in san jose and palo alto also is very wet here. not only highway 101, but also 280. and in san francisco and downtown, it's about to get a little bit more wet.

not as heavy as what we had earlier tonight, but definitely a little shower activity coming your way. next 48 hours, what we're tracking out on the satellite loop is an expansive system. one of the largest systems we've probably seen since about january, february, and march of last year. we're going to see that eventually impact as we head throughout friday this upcoming week. for tomorrow, a few spotty showers as this stubborn area of low pressure pushes to the south. it will provide those hit and miss spotty showers with temperatures in the 50s and 60s a the coastline. plenty of autumn air with 60s and also 70s in the valleys. for the overnight hours, no heavy widespread consistent rainfall. you can see the green is very spotty. but by tomorrow at about 3:00, 4:00, and 5:00, when we get some daytime heating, what we'll find is more of what we had for tonight. some spotty areas of showers popping up in the south bay, east bay and also for the peninsula. not only that, but if you're headed anywhere near the sierra, let's say yosemite, 1 to 3

inches of snow expected over the next 48 hours. do be prepared for winter conditions. up across the north bay tonight, low 40s expected. 50s across the east bay. and daytime highs tomorrow will be in the low to mid-70s. let's get you into the thee-day forecast. temperatures also in the low to mid 70s the next three days. and as we head throughout next week, we'll get warming with low to mid-80s. so we're kind of going up and down on the temperatures. but just be aware for tomorrow. we do have a chance of isolated thunder in the forecast, and then another chance of showers for friday. >> going to break out the umbrella. >> yes, keep it close by. >> thanks. >> hope i can find the umbrella. we'll be right back. measures... measure up. money to our schools.
